Terms & Conditions

These terms and conditions provide a comprehensive framework for bookings and ensure clarity and fairness for both parties.

 

An agreement entered into between the first party, referred to as the Client, and At The Helm (UK) Ltd t/a The Singing Wedding Waiters, subsequently referred to as the Company, as the second party.

 

It is hereby witnessed that the Client undertakes to engage the Company who accepts the engagement to present the following at the Venue, on the date specified in the schedule hereto and at the fees outlined therein.

 

THE FOLLOWING CLAUSES FORM AN INTEGRAL PART OF OUR TERMS AND CONDITIONS:

 

Cancellation terms for this Contract are outlined as follows:

 

- Cancellation occurring more than 14 days after the agreement is finalized: No refund shall be payable.

- Within 30 days from the performance date: The FULL Fee becomes payable.

- The Company confirms that the fee encompasses all expenses, including travel costs to and from the venue, and covers any relevant payments.

- The Client agrees that any subsequent engagements offered to the Company resulting from this agreement, whether from the Client under this contract or any other Client or prospective Client, shall be negotiated through the Company's head office, not directly with the featured Artist of the day.

- The Company assures that all equipment is in satisfactory working condition and suitable for its intended purpose, with no aspect of the performance posing a risk to the Artist/s or any other individuals.

- Volume and sound adjustments of equipment shall be made to the Client's reasonable specifications.

- No refund shall be issued to the Client for any date during which this engagement is interrupted due to circumstances such as Royal Demise, National Mourning, Fire, Epidemic, Pandemic, War, Strikes, lockout, or by order of any Licensing or Public Authority.

- At the time of making this agreement, the Company shall not be bound by any conflicting contracts with third parties that may hinder their ability to fulfil the engagement.

- The Client is responsible for providing mains electricity in the performance area.

- All deposits made are non-refundable.

- FULL payment becomes non-refundable 14 days following the initial booking fee payment.

-Verbal agreement to these terms and conditions, shall be considered accepted if it remains unchanged for the prescribed 14 days period, and no written objections are raised within this timeframe.

 

Social Media Terms and Conditions for At The Helm (UK) Ltd t/a The Singing Wedding Waiters

 

The promoter is: At The Helm (UK) Ltd t/a The Singing Wedding Waiters, registered at Lytchett House, 13 Freeland Park, Poole, Dorset, England, BH16 6FA (company no 09018854).

 

Any competition and/or promotion published on any social media platform is open to residents of the United Kingdom aged 18 years or over, excluding employees of At The Helm (UK) Ltd and their close relatives, and any individuals connected with the organisation or judging of the competition.

 

These Terms and Conditions ("Terms"), along with any other referenced documents herein, establish the terms applicable to all bookings made through us. Both parties are bound by these terms and conditions. Please review these Terms carefully and ensure you understand them before making any booking through our website, telephone, or email. By making a booking, you agree to accept these Terms.

 

Interpretation

1.1. Definitions. In these Terms, the following definitions apply:

- Bookings: refers to the booking of Performers for weddings, events, and functions made available via our Website, telephone, email, or associated agents.

- Charges: the fees payable by the client for Bookings purchased.

- Client: the individual(s) or customer making a booking.

- Performers: individuals who will attend and perform at the event.

- Services: services provided by the Company to the Client as per the Booking.

Application of Terms

2.1. By using the Website and making a Booking, you agree to comply with and be bound by these Terms. If you do not agree to these Terms, you must not make a Booking.

2.2. We will make reasonable efforts to notify you in case of any changes to these Terms. You agree to be bound by the version of these Terms displayed on the Website at the time of booking.

 

Booking Process

3.1. Bookings can be made via our enquiry form, email, or phone, available 24/7.

3.2. Upon booking, a booking fee is required to secure the date. If booked directly, the booking fee can be made by bank transfer, by the card payment facility as specified in the initial invoice. The booking becomes binding on receipt of the booking fee.

3.3. Booking fees are non-refundable once the date is confirmed and performers' availability is secured.

3.4. Clients are responsible for providing suitable food and beverages for the performers at the venue.

 

Charges and Payment

4.1. Charges for bookings depend on factors such as location, venue size, performers required, performance duration, and special arrangements. Performers reserve the right to reject bookings due to venue issues such as sound limiters or traffic management. In such cases, no refund of any booking fees paid will be issued. Please make sure all reasonable attempts have been made to check the suitability of the preposed venue, including provision of a save performance space. Outdoor performances must be agreed in advance of booking.

4.2. A non-refundable booking fee is required when booking The Singing Wedding Waiters.

4.3. Payments should be made as directed on the invoice.

4.4. The final balance must be paid at least 2 weeks before the event.

4.5. Failure to make full payment will result in a booking cancellation. However fees will still be due in full. Non-payment will result in legal action. 

 

Performances

5.1. Start times assume access to the performance area before the agreed start time. If the event runs behind schedule, The Singing Wedding Waiters reserve the right to perform within 60 minutes of the agreed start time.

5.2. Clients may not change the venue or date without written agreement by both parties. Any additional charges due to changes will be communicated and invoiced accordingly. If unable to accommodate changes, the booking will be canceled, with the booking fee non-refundable.

5.3. In case a performer is unable to perform due to illness or injury, a suitable replacement will be provided. If a replacement cannot be found, a full refund will be issued.

 

Cancellation

6.1. Clients may cancel a Booking, subject to cancellation fees:

- 100% of the remaining balance if canceled after 14 days from paying the booking fee.

6.2. Cancellation notice must be emailed to info@singingweddingwaiters.co.uk

6.3. All cancellation fees are payable within 7 days and made via bank transfer.

6.4. Failure to pay may result in legal action for breach of agreement.

 

Force Majeure

9.1. A Force Majeure Event includes events beyond our control, such as strikes, utility service failures, personal illness, natural disasters, etc.

9.2. We shall not be liable for failure to perform obligations due to a Force Majeure Event.

9.3. We will attempt to provide a suitable replacement in case of cancellation due to Force Majeure, with refunds issued if no replacement is found.

 

General

10.1. We reserve the right to change the Website's domain and content, services, and prices at any time.

10.2. Each sub-clause of these Terms is independent. An unenforceable status of one clause does not affect any other.

10.3. Delay in enforcing our rights does not forfeit them unless agreed otherwise in writing.

10.4. Failure to enforce one breach does not affect enforcement any other.

10.5. Governing law: These Terms are governed by English law, with exclusive jurisdiction of English Courts.
